A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.
In her decision, the judge noted that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
The legal challenge involve disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
